Shoreline Adventures (PTY) LTD (hereinafter referred to as “Cape Town Lodges”, “we” or “us”), South African company reg. no. 2024/411556/07 provides accommodation services in Blouberg, Cape Town. These Terms and Conditions govern the contractual relationship between Cape Town Lodges and the Traveler when booking accommodations through our website (www.capetownlodges.com), participating in activities, or purchasing related products or services. Please read these Terms carefully before booking your stay or purchasing related products or services.
1. Definitions
1.1. “Agreement”: These Terms, the Booking Confirmation, and other brochures, catalogs, and printed materials provided by Cape Town Lodges. 1.2. “Booking Confirmation”: The confirmation of the Traveler’s booking of accommodation sent to the Traveler if the booking is accepted. 1.3. “Traveler”: Natural persons and businesses who book accommodations or services from Cape Town Lodges.
2. The Booking
2.1. By booking accommodation, you acknowledge that you have read, understood, and agree to be bound by these Terms. 2.2. When a booking is submitted, Cape Town Lodges will send you a Booking Confirmation. The booking is binding upon both parties only when such Booking Confirmation has been sent to you. 2.3. If you make a booking on behalf of other participants, you guarantee that you have the authority to accept and do accept these Terms on behalf of the other participants in your party. 2.4. Anyone under the age of 18 traveling without a parent or guardian requires written consent from a parent or guardian. 2.5. A minor participating in any activities must bring the original written consent in signed form and deliver it upon arrival. Cape Town Lodges reserves the right to reject a Traveler without necessary documents.
3. Obligations of the Traveler
3.1. The Traveler is responsible for having a complete and valid passport and other necessary travel documents, including visas and vaccinations if required. 3.2. Travelers must acquire travel insurance that covers medical treatment and activities. 3.3. The Traveler is responsible for booking flights and other transport to the destination. 3.4. The Traveler shall review the Booking Confirmation and other travel documents upon receipt and ensure all information is correct. 3.5. The Traveler shall immediately inform Cape Town Lodges of any changes to their contact information. 3.6. The Traveler shall behave in a manner that does not impair the comfort and enjoyment of other guests. Cape Town Lodges reserves the right to withdraw any booking or refuse any individual as a guest if their behavior is deemed inappropriate. 3.7 Guest Responsibility for Damages: The Traveler agrees to take responsibility for any damages to Cape Town Lodges’ properties or facilities caused by their actions or negligence. Cape Town Lodges reserves the right to charge for repairs or replacements as necessary.
4. Price and Payment
4.1. Information in brochures and catalogs is binding unless we explicitly reserve the right to make changes. 4.2. The total price of the accommodation will be clearly stated, including all services and taxes. 4.3. Payment can be made via credit/debit cards. A deposit of 50% is required at the time of booking, with the remaining 50% due 14 days prior to arrival. 4.4. If the accommodation is booked less than 14 days before arrival, full payment is due at the time of booking. 4.5. Special arrangements are included in the Agreement only if sold or marketed together with the main arrangement.
5. Cancellation Policy
5.1. Cape Town Lodges offers a full refund policy for bookings made more than 60 days prior to arrival. 5.2. Written cancellation must be sent to hey@capetownlodges.com with the booking number included within the specified time limit.
6. Changes and Cancellations by Cape Town Lodges
6.1. Cape Town Lodges may change the terms of the Agreement after it has been concluded. If the accommodation cannot be provided as agreed, the Traveler will be informed as soon as possible. 6.2. If changes result in a reduction in the value of the accommodation, the Traveler is entitled to a price reduction. 6.3. If we cannot fulfill the Agreement and this constitutes a significant breach of contract, the Traveler may cancel the Agreement and receive a full refund. 6.4. Force Majeure: Cape Town Lodges shall not be held liable for any loss, damage, or cancellation due to events beyond our reasonable control, including but not limited to natural disasters, government restrictions, or other force majeure events.
7. Traveler’s Right to Cancel
7.1. Cancellations must be made in writing to hey@capetownlodges.com. The date Cape Town Lodges receives the cancellation will determine the refund amount. 7.2. Cancellation terms:
– 61 days or more before arrival: 100% refund
– 60 days or less before arrival: 50% refund
– 30 days or less before arrival: 20% refund
– 14 days or less before arrival: no refund
8. Participation in Activities
8.1. Cape Town Lodges is not responsible for activities organized by third parties. Different terms may apply to these activities. 8.2. Travelers participate in activities at their own risk and must assess their own fitness for travel and participation. 8.3. Medical forms may be required for certain activities. Cape Town Lodges reserves the right to deny participation based on physical or mental fitness.
9. Limitation of Liability
9.1. Cape Town Lodges is not liable for any injury, damage, loss, or delay not arising from our negligence. 9.2.Cape Town Lodges provides access to pools, BBQ facilities, and gas stove for the enjoyment of our guests. However, use of these facilities is strictly at the Guests’s own risk. Cape Town Lodges will not be liable for any injury, damage, or loss resulting from the use of these amenities. Guests are expected to exercise caution, adhere to safety instructions, and supervise children at all times when using these facilities. 9.3. Our maximum liability for any loss, damage, or expense shall not exceed the amount paid for the accommodation.
10. Governing Law and Dispute Resolution
10.1. This Agreement shall be governed by the laws of South Africa. 10.2. All disputes shall be settled by the courts of South Africa.
